I have settled the accompanying Draft after

consultation with Mr. Chatham and Mr. Booth of the Board

of Trade. The use of square brackets denotes that the words included in the brackets are inserted for considera- tion.

Two alternative forms of title are suggested; the first should be used if clause 4 is ultimately excluded, the second if clause 4 is included.

The proviso to clause 3 follows the form of the proviso to Section 4 (1) of the English Electric Lighting Act, 1888. It is presumably not intended that the regulations should be applicable in the case contem- plated.

Clause 4 is inserted for consideration. understood my instructions the ordinance is only intended to extend to securing the safety of the Public. English electric undertakers on the other hand are subject to various other regulations and restrictions as respects contimity of supply, price, &c. (See Flectric Lighting Act, 1882, S. 6)

Mr. Chatham thought that it might be advisable at some future date to subject the Hong Kong Companies to similar conditions, and clause 4 accordingly confers

a wide general power on the Governor in Council

to make regulations.
